In today’s digital age, the journey from creation to audience is swift. You upload a beat, post a
video, or release a newsletter essay. Yet, amid this creative flow, the movement of rights
often goes unnoticed. Somewhere between your phone and the internet, rights are
exchanged. Do you know where they go? Digital Rights Management (DRM) aims to bridge this
gap.

What is DRM Really About?

For most of the past two decades, DRM has been associated with restrictive measures: locked
files, region codes, and lawsuits targeting teenagers. However, the essence of DRM is
different. It seeks to answer this fundamental question: Who has the right to do what with this
content, and how can we prove it?
Every recording has an International Standard Recording Code (ISRC), every product a
Universal Product Code (UPC), and every book an International Standard Book Number
(ISBN). These identifiers form the backbone of ownership in the commercial world. As an
independent creator, if you’re unaware of the “rail” your work travels on, someone else might
be collecting your dues.

The Current Turning Tide of Rights Management could equal
cash flow

Historically, rights management has been dominated by three main entities: the U.S.
Copyright Office, performance rights organizations like ASCAP, BMI, and SESAC, and
distributors controlling identifier assignment. The process involved filing, registering, waiting,
and hoping the paper trail held if contested.
However, the landscape is evolving. Technologies like blockchain offer new methodologies.
Blockchain-based timestamping can fix a cryptographic hash of your work to an immutable
ledger the moment you create it. Smart contracts enable royalty splits that automatically pay
out without a middleman. ERC-1400-class tokens can represent fractional rights in a catalog,
similar to how UCC Article 8 represents ownership in a security. Traditional legal frameworks
aren’t disappearing; they’re being automated for greater efficiency and transparency.

Taking Control of Your Creative Rights

The paradigm is shifting, empowering creators to take control of their work’s value. You no
longer need to rely on labels, publishers, or platforms to determine your work’s worth. You
can timestamp, identify, register, and eventually tokenize your creations yourself. This is the
mission of this blog series.
In the upcoming posts, I will guide you through establishing your own rights infrastructure.
We’ll explore topics such as ISRC assignment, UPC registration, blockchain timestamping,
tokenized royalty splits, and even the intricacies of Rule 144A private placements for creative
catalogs. Together, we’ll delve into the legal architecture that underlies these processes.
This journey is about earning what is rightfully yours, not through hustle, but through a
system—a system where you live free, learn the code, and earn your due. Join me as we
unravel the complexities of DRM and empower independent creators to claim ownership and
control in the digital realm.
